eli lilly zyprexa rico lawsuit
Published Aug. 21, 2008"Through a complex series of illegal rackets and lies, Eli Lilly drug company built a multi-billion dollar drug enterprise at the expense of taxpayers, consumers and patient lives". Zyprexa remains on the market in the United States and more than 80 other countries. About 30 state attorneys general have subpoenaed documents detailing Lilly's sales practices for Zyprexa as part of a civil investigation under state consumer protection laws. Zyprexa qualifies for a MedGuide warning:
(1) The labeling would definitely help prevent serious adverse events;
(2) Few patients would be willing to take the drug and risk developing diabetes given that numerous studies have shown Zyprexa to be no more effective than the older class of antipsychotics that do not cause diabetes; and
(3) Most patients on Zyprexa would learn that the drug is not FDA approved to treat the condition they have.

I understand that, but the lawyers will need to prove that Lily was encouraging physicians to prescribe the drug off label.
But you also have to remember that is the physicians final choice to write the prescriptions for their patients, regardless of what the drug reps tell them.
www.rxlist.com has a copy of the label and it say "ZYPREXA is indicated for the treatment of schizophrenia or acute mixed or manic episodes associated with Bipolar I Disorder."
The Physician make a conscious decision to prescribe off label. And not to belittle dannyhaszard's situation, but the label also states that diabetes mellitus is an infrequent side effect. Check it out on page 3

How is the drug company responsible if your physician incorrectly prescribes this for your condition? Oh yeah, the drug companies have the big bucks...
